Terms of Service
Effective date: May 16, 2026
These Terms of Service (“Terms”) govern use of Qida, the mobile application for iOS and website qida.io (together, the “Service”), operated by Synergy Data Analytics, C.A. (“Qida”, “we”, “us”). Installing, registering an account or using the Service means accepting these Terms. If you disagree, do not use the Service.
1. What Qida is
Qida is a personal app for remembering medicines, recording doses, comparing prices at nearby pharmacies and talking with Vita, an AI assistant limited to prices, pharmacies and medicine-list management.
2. Acceptance of the Terms
These Terms constitute an agreement between you and Qida. By using the Service, you confirm you have read, understood and accepted these Terms and the Privacy Policy, which is an integral part of this agreement.
3. Qida is not a medical device
Qida is not classified or authorized as a medical device by any health authority. It does not replace professional consultation. Treatment, doses, medicine changes, interactions, allergies and emergencies must be addressed by a qualified health professional. In a medical emergency, immediately contact your country’s emergency services.
4. Medication reminders — delivery not guaranteed
Qida schedules local notifications on your device. Delivery depends on factors beyond our control:
- Operating system and updates.
- Notification, sound, Focus or Do Not Disturb settings.
- Battery and low-power mode.
- Force-quitting, restarts or insufficient storage.
- Permissions revoked by you.
We therefore do not guarantee delivery of every reminder. You are responsible for taking medication. For critical treatment, configure additional safeguards (other reminders, device alarms, caregiver support, a physical pill organizer, etc.).
5. Vita (AI assistant)
Vita uses generative AI (Mistral Ministral 3 14B running on Amazon Bedrock), exclusively to:
- Search the medicine catalogue.
- Compare prices at nearby pharmacies.
- Create and manage price alerts.
- View the saved medicine list.
Vita does not give medical advice, diagnose, recommend treatments or replace a health professional. Medical questions are referred to the appropriate professional. Responses may nevertheless contain errors or outdated or inaccurate information. Do not make clinical decisions based on Vita without checking with your doctor or pharmacist.
Before the first message, you must explicitly consent to the processing in the Privacy Policy. You may disable Vita at any time; the rest of the Service remains available.
6. Pharmacy prices and information
Medicine prices and pharmacy information come from public sources and associated pharmacies. They may be outdated, omit local promotions or contain errors. Before purchasing, verify price and availability directly with the pharmacy. Qida is not a purchase intermediary and does not guarantee the quality, authenticity or legality of pharmacy products.
7. Your account
- You are responsible for the accuracy of recorded information.
- You are responsible for keeping your password private and for actions performed with your account.
- If you suspect unauthorized access, immediately email soporte@qida.io.
- You may sign out or delete your account at any time in Profile → Privacy and security.
8. Eligibility and capacity
You must be at least 18 and legally capable of contracting in your country of residence. Minors may be assisted through an adult caregiver account (role “caregiver”), whose holder accepts these Terms on their behalf and assumes responsibility for processing the minor’s data.
9. Acceptable use
You agree not to:
- Use Qida for unlawful purposes or to harm third parties.
- Impersonate anyone or record another person’s data without consent, except through the caregiver role.
- Attempt unauthorized access to others’ data or infrastructure.
- Decompile, reverse engineer, modify or create derivative works of the software.
- Interfere with service operation, overload it or bypass security mechanisms.
- Send unlawful, harassing, false or fraudulent content, or content infringing third-party rights.
We may suspend or cancel accounts that violate these rules.
10. Caregivers and third-party data
If you use the caregiver role to record medicines or data for another person, you declare you have their consent or the necessary legal representation under your country’s laws. You are responsible for informing them of data processing under the Privacy Policy.
11. Intellectual property
Qida, its name, logo, design, source code, editorial content and databases belong to Synergy Data Analytics, C.A. or its licensors and are protected by intellectual property laws. We grant a personal, limited, non-exclusive, non-transferable, revocable license to use the app under these Terms. You retain ownership of your recorded data and grant the minimum license necessary to store and process it under the Privacy Policy.
12. In-app purchases
Qida currently offers no paid plans. If subscriptions or purchases are enabled in future, they will be processed exclusively through Apple In-App Purchase under its terms. Prices, billing cycles and renewal conditions will be prominently displayed before payment; automatic renewals require your explicit consent. Cancellations and refunds follow Apple policies.
13. Termination
You may terminate this agreement at any time by deleting your account. We may suspend or terminate access for violations of these Terms or applicable law, with reasonable advance notice except for serious abuse, security risk or legal requirement. Termination does not affect previously accrued rights and obligations.
14. Limitation of liability
The Service is provided “as is” and “as available”, without warranties except those mandatorily required by law. To the maximum extent permitted:
- We are not liable for indirect, incidental or consequential damages, lost profits, data or opportunities arising from use.
- Total accumulated liability for any related claim is limited to the amount you paid for the Service in the previous 12 months (zero if you paid nothing).
This does not exclude or limit: (a) liability for wilful misconduct or gross negligence; (b) liability for harm to life or physical integrity provably caused by the Service; (c) non-waivable consumer rights under applicable law, including Argentina’s Consumer Defence Law, Brazil’s CDC, Chile’s Consumer Law/SERNAC, Mexico’s PROFECO and Colombia’s SIC.
15. Indemnification
You agree to indemnify Qida and its collaborators against third-party claims arising from use in violation of these Terms, particularly uploading third-party data without consent.
16. Changes to these Terms
We may update these Terms for service or legislative changes. Material changes are notified at least 30 days in advance through a prominent in-app notice and, where possible, email. If you disagree, stop using the Service and delete your account before the effective date. Subsequent use signifies acceptance of the amended Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Bolivarian Republic of Venezuela, without prejudice to non-waivable consumer rights under the laws of your country of residence. Disputes are resolved by the competent courts of Caracas, Venezuela, unless mandatory consumer law establishes a different jurisdiction.
18. Apple Standard EULA
These Terms supplement Apple’s Licensed Application End User License Agreement for App Store apps. In a conflict concerning App Store distribution and use, Apple’s EULA prevails. Apple Inc. is not a party and is not responsible for the app, content, maintenance, support or related claims. For breach of applicable statutory warranties, you may notify Apple for a purchase-price refund, if any; Apple has no other obligation.
19. Miscellaneous
- Entire agreement: these Terms and Privacy Policy constitute the entire agreement concerning the Service.
- Severability: invalidity of one provision does not affect the others.
- No waiver: failure to exercise a right does not waive it.
- Assignment: you may not assign these Terms without our consent. We may assign them in a corporate reorganization with advance notice.
- Force majeure: we are not liable for non-performance caused by fortuitous events, force majeure or causes beyond reasonable control.
